Does selling my rental end the tenant's lease?

Generally, no. In Nevada, as in most states, a sale does not by itself cancel an existing lease. The buyer usually takes the property subject to the tenancy and becomes the new landlord on the same terms. Some leases include language about what happens on a sale, so read yours carefully and ask a Nevada attorney if the wording is unclear.

What if my tenant is on a month-to-month arrangement?

A month-to-month tenancy can generally be ended by either side with proper written notice, which Nevada law sets at thirty days for a monthly tenancy, as we understand it. There are rules about how notice is delivered and it cannot be retaliatory or discriminatory. We are happy to buy with a month-to-month tenant staying on, so ending the tenancy is never a requirement.

How much notice do I give before the walk-through?

Nevada generally requires at least 24 hours of notice before a landlord enters, except in an emergency, and entry should happen at reasonable times. Showing the home to a prospective purchaser is one of the recognized reasons for entry. We are glad to schedule further out than the minimum so the household can plan around the visit.

Can I show the house without the tenant's cooperation?

A tenant should not unreasonably refuse entry that follows proper notice, but the landlord is also not allowed to abuse access or use it to harass. In practice, cooperation goes much better than confrontation. If a visit is not possible, we can sometimes start from photos, a video tour, or information from your property manager instead.

What happens to the security deposit at closing?

Under NRS 118A, once a sale ends an owner's interest in the rental, that landlord either transfers the remaining deposit to the new owner and tells the tenant in writing who that owner is, or returns the deposit to the tenant. The statute also points to handling this in writing before the deed records. We include the transfer in the closing paperwork.

Can the new owner ask the tenant for a bigger deposit?

Nevada's statute says the successor owner accepts the tenant's existing security and may not require additional security during the term of the current rental agreement. That is how we approach it: the deposit transfers as it is, and the tenant is not asked for more while their existing lease runs. Questions about deductions belong with a Nevada attorney.

Can I deduct for damage before transferring the deposit?

The statute refers to the portion remaining after deductions that NRS 118A otherwise allows, so legitimate deductions may be possible in some cases. The rules about what can be deducted and how it must be documented are specific. This is an area where we recommend speaking with a Nevada attorney rather than guessing, since mistakes can create liability.

Does the rental need fixing before you buy it?

No. We purchase rental houses as-is. You do not need to repair the roof, replace carpet, service the air conditioning, or clean out anything a former tenant left behind. That is especially helpful when the house is occupied, since scheduling contractors around a household can be slow and disruptive for everyone involved.

Is there a commission when I sell to you?

No listing-side commission applies on our end, because we buy the rental directly rather than through a listing. You may have ordinary closing costs, and those will be shown in the purchase agreement before you sign. If a property manager handles the house, their agreement may have its own sale or termination terms, so review it early in the process.

My property manager has a contract. Does that stop a sale?

A management agreement usually does not prevent you from selling, but it may require written notice to terminate, and some include a fee tied to a sale or early termination. Read the agreement or ask the manager directly. Knowing those terms early helps you set a closing date that matches the manager's notice period.

Can you buy a house with a Section 8 tenant?

Yes. In Southern Nevada, the housing choice voucher program is administered by the Southern Nevada Regional Housing Authority. When ownership changes, the housing assistance payments contract generally has to be reassigned to the new owner, which involves paperwork such as a copy of the recorded deed and payment details. We handle our side of that process.

Will a voucher tenant lose assistance because of the sale?

A sale by itself is not meant to end a family's assistance. The housing authority generally reassigns the contract to the new owner so payments continue. Details depend on the authority's current procedures, so confirm with the housing authority directly. We plan on keeping voucher tenancies in place and completing whatever reassignment forms the authority requires.

What if an eviction case is already open?

Nevada's summary eviction process runs through the justice court, and the tenant has the right to respond with an affidavit. We do not give legal advice or coach evictions. A pending case does not necessarily stop a sale, but timing and who continues the case are questions for your attorney. Tell us about it upfront so we can plan honestly.

I live out of state. Can I sell without flying to Las Vegas?

In most cases, yes. Title companies commonly arrange remote or mobile signing, and your property manager or a trusted local contact can coordinate access for the walk-through. Documents can be reviewed electronically. Let us know where you are and we will plan the steps so you can handle them from home.

Can you close around a 1031 exchange?

We can set closing on the date you choose, which helps when you are working with exchange deadlines. We do not provide tax advice, and 1031 rules are strict about identification and timing, so work with a qualified intermediary and your own tax professional. Once you have your target dates, we will plan the closing to fit them.

How fast can you close?

We avoid quoting a set count of days. Title, liens, HOA requirements, and the lease all affect timing. What we can promise is that the landlord names the closing date and our team plans the sale around it. Some owners want to close soon; others prefer to wait for a lease to end or a new purchase to line up.
